Probate Law

Probate, in essence, is the process of administering a person’s estate after they have died, allowing for the organizing of the deceased person's money, assets and possessions and distributing them to their heirs or whomever they have designated in their Last Will and Testament.

When a loved one dies, it is a difficult time for those who are left behind. There are certain things that must be done immediately following their passing like the funeral and burial arrangements. However, after the burial there can still be many issues that need to be dealt with. Your loved one may have had bank accounts in their own name, a vehicle, real estate, etc. Any assets that are left in the deceased’s name will need to be probated. If the deceased had a Last Will and Testament then that document will dictate how those assets will be distributed. If there is not a Will, then there is a statute designating who the heirs are for that person. Either way, it is a time where you will need the support and guidance of an attorney experienced in probate law.
